estatus migratorio y sus derechos

Independientemente de su estatus migratorio, todos están protegidos por la Constitución de EE. UU.

Bajo la Quinta Enmienda usted tiene derecho a permanecer en silencio.
Bajo la Cuarta Enmienda usted tiene derecho a negarse a un registro sin orden judicial
Bajo la Primera Enmienda usted tiene derecho a grabar a las fuerzas del orden.

Favor de revisar la información en esta página y elaborar un plan.

Si va conduciendo a un sitio de trabajo y ICE le detiene:

No abra la puerta ni baje el vidrio de su carro completamente. (Solo lo suficiente para comunicarse con los agentes).
Llame a la línea directa: 913.999.2398
Si los agentes le preguntan por su estatus migratorio, diga “Quiero guardar silencio.”
- No tiene que responder a NINGUNA pregunta

Pida ver una orden judicial firmada por un juez.
- La orden tiene que ser emitida por un Tribunal de Distrito de los Estados Unidos (United States District Court), NO emitida por Seguridad Nacional (Homeland Security).
- Tome una foto de cualquier documento que le muestren.
Una persona debe llamar a la línea directa: 913.999.2398 y dar su ubicación.
Otra persona en el vehículo debe grabar la interacción.
¿NO HAY ORDEN JUDICIAL? PREGUNTE SI ES LIBRE DE RETIRARSE.

Si está en una obra y aparece ICE:

Manténga la calma y no corra.
A una persona se le debería asignar el papel de interactuar con ICE.
Pida una orden judicial firmada por un juez Emitido por el Tribunal de Distrito de los Estados Unidos, NO por Seguridad Nacional.
Tome una foto de cualquier documento.
Una persona debería llamar a la línea directa: 913.999.2398
Una persona debería grabar la interacción.
¿NO HAY ORDEN JUDICIAL? PREGUNTA SI PUEDE RETIRARSE.

Cuándo mostrar su documentación:

Cuando un agente de inmigración pida sus papeles, muéstrelos solo si los lleva con usted.
Si le detiene la policía, highway patrol o el sheriff por INFRACCIÓN DE TRÁFICO, muéstrele, la licencia, el seguro y registración del auto. No necesita responder preguntas sobre inmigración.

What to do if ICE approaches you

If you are driving to a job site and ICE stops you:

Do not open the car door or window. (Crack window only to speak)
Call the hotline: 913.999.2398
If asked about your status, say “I want to remain silent.”
- You don’t have to answer ANY questions
Ask for a judicial warrant signed by a judge.
- Issued by United States District Court NOT Homeland Security.
- Take a photo of any document.
Someone in the vehicle should record the interaction.
NO JUDICIAL WARRANT? ASK IF YOU ARE FREE TO LEAVE

If you are on a job site and ICE appears:

Stay calm and do not run.
One person should be assigned the role of interacting with ICE.
- Ask for a judicial warrant signed by a judge
  - Issued by United States District Court NOT Homeland Security.
  - Take a photo of any document.
One person should call the hotline: 913.999.2398
One person should record the interaction.
NO JUDICIAL WARRANT? ASK IF YOU ARE FREE TO LEAVE

When to share documentation:

If asked by an immigration agent for papers, show them only if you have them on you.
If stopped by police, highway patrol or sheriff for a TRAFFIC VIOLATION, show license, registration, and insurance, but you don’t need to answer immigration questions.
